How do I comment/approve/refuse an application?

Manage Conditions

The Manage Conditions document allows Responsible Authority users to create conditions that need to be met prior to certification and/or Statement of Compliance (SOC).

 

Using this function will prevent the Certification or SOC decision being made until the Responsible Authority is satisfied conditions for the relevant stage have been met.

 

Use of this function will provide the applicant and referral authorities with information about which conditions are outstanding. Applicant, referral authorities and Responsible Authority users have the ability to provide comments and/or evidence of completion of conditions.

 

'Manage Conditions' is available to the Responsible Authority as an optional action once the application status reaches ‘Permit Decision’ or ‘Certification Decision Pending’ (in the case of a standalone certification application).

Issuing a permit decision

The Responsible Authority adds the permit as a PDF in SPEAR and authenticates it. SPEAR will then notify relevant parties via email.

 

An objector who lodges an objection to the application in SPEAR will also be notified via email of the Responsible Authority’s decision.

Issuing a certification decision

When all of the responses to a certification referral (Section 8) have been supplied in SPEAR by the referral authorities, the status of the application will move to ‘Certification Decision Pending’. The Responsible Authority will then be prompted to make a decision.

 

When the Responsible Authority is satisfied that the plan is ready to be certified, it must select the mandatory action ‘make decision – Cert of Subdiv’ from the Details tab.

 

The Responsible Authority will then be presented with the relevant certification options depending on the application status and whether certification and/or SOC have already been achieved for the application previously.

 

Once the certification decision has been finalised by authentication with a digital signature a notification email will be sent to the Applicant Contact and referral authorities advising them of the outcome.

Statement of compliance decision

Once the certification decision has been finalised and all of the consents to a SOC referral (Section 8) have been supplied in SPEAR by the referral authorities, the status of the application will move to ‘SOC Decision Pending’. A mandatory action will be placed on the Responsible Authority to make the SOC decision. Once the decision is made and authenticated in SPEAR, a notification email will be sent to the Applicant Contact and referral authorities advising of the outcome. The status of the application will be ‘Statement of Compliance’.

 

A certification and SOC can be actioned together (Form 6) if all the responses have been received in SPEAR. The status of the application changes to ‘Statement of Compliance’ (SOC), and the Applicant Contact and referral authorities will be notified by email that the plan has been certified and a SOC has been issued.
